    SUMMARY: This is a notice of the Presidential declaration of a major 
    disaster for the State of North Dakota (FEMA-1174-DR), dated April 7, 
    1997, and related determinations.
    
    EFFECTIVE DATE: April 7, 1997.

    SUPPLEMENTARY INFORMATION: Notice is hereby given that, in a letter 
    dated April 7, 1997, the President declared a major disaster under the 
    authority of the Robert T. Stafford Disaster Relief and Emergency 
    Assistance Act (42 U.S.C. 5121 et seq.), as follows:
    
        I have determined that the damage in certain areas of the State 
    of North Dakota, resulting from severe flooding, severe winter 
    storms, heavy spring rain, rapid snowmelt, high winds, ice jams, and 
    ground saturation due to high water tables beginning on February 28, 
    1997, and continuing, is of sufficient severity and magnitude to 
    warrant a major disaster declaration under the Robert T. Stafford 
    Disaster Relief and Emergency Assistance Act (``the Stafford Act''). 
    I, therefore, declare that such a major disaster exists in the State 
    of North Dakota.
        In order to provide Federal assistance, you are hereby 
    authorized to allocate from funds available for these purposes, such 
    amounts as you find necessary for Federal disaster assistance and 
    administrative expenses.
        You are authorized to provide Individual Assistance and Hazard 
    Mitigation in the designated areas. Further, you are authorized to 
    provide reimbursement for debris removal and emergency protective 
    measures under the Public Assistance program. Should snow removal 
    assistance be necessary, you are authorized to provide reimbursement 
    for the costs of equipment, contracts, and personnel overtime that 
    are required to clear one lane in each direction along snow 
    emergency routes (or select primary roads in those communities 
    without such designated roadways) to hospitals, nursing homes, and 
    other critical facilities. Other categories of assistance under the 
    Public Assistance program may be added at a later date, as you deem 
    appropriate. Consistent with the requirement that Federal assistance 
    be supplemental, any Federal funds provided under the Stafford Act 
    for Public Assistance will be limited to 75 percent of the total 
    eligible costs.
    
        The time period prescribed for the implementation of section 
    310(a), Priority to Certain Applications for Public Facility and Public 
    Housing Assistance, 42 U.S.C. 5153, shall be for a period not to exceed 
    six months after the date of this declaration.
        Notice is hereby given that pursuant to the authority vested in the 
    Director of the Federal Emergency Management Agency under Executive 
    Order 12148, I hereby appoint Leslie Rucker of the Federal Emergency 
    Management Agency to act as the Federal Coordinating Officer for this 
    declared disaster.
        I do hereby determine the following areas of the State of North 
    Dakota to have been affected adversely by this declared major disaster:
    
        Adams, Barnes, Benson, Billings, Bottineau, Bowman, Burke, 
    Burleigh, Cass, Cavalier, Dickey, Divide, Dunn, Eddy, Emmons, 
    Foster, Golden Valley, Grand Forks, Grant, Griggs, Hettinger, 
    Kidder, Lamoure, Logan, McHenry, McIntosh, McKenzie, McLean, Mercer, 
    Morton, Mountrail, Nelson, Oliver, Pembina, Pierce, Ramsey, Ransom, 
    Renville, Richland, Rolette, Sargent, Sheridan, Sioux, Slope, Stark, 
    Steele, Stutsman, Towner, Traill, Walsh, Ward, Wells, and Williams 
    Counties for Individual Assistance and Hazard Mitigation.
        Barnes, Benson, Bottineau, Burke, Burleigh, Cass, Cavalier, 
    Dickey, Divide, Eddy, Emmons, Foster, Grand Forks, Griggs, Kidder, 
    Lamoure, Logan, McHenry, McIntosh, McLean, Morton, Mountrail, 
    Nelson, Pembina, Pierce, Ramsey, Ransom, Renville, Richland, 
    Rolette, Sargent, Sheridan, Steele, Stutsman, Towner, Traill, Walsh, 
    Ward, Wells, and Williams Counties for debris removal and emergency 
    protective measures under the Public Assistance program.
