Notice of Lodging of Consent Decree Pursuant to the Clean Water
Act
In accordance with Departmental policy, 28 CFR Sec. 50.7, and 42
U.S.C. Sec. 9622(d), notice is hereby given that a proposed consent
decree in United States v. Kennecott Greens Creek Mining Company, Civil
Action No. A97-0099-CV (JWS), was lodged on March 19, 1997 with the
United States District Court for the District of Alaska. The Complaint
in this case alleges that Kennecott Greens Creek Mining Company
(``Greens Creek'') discharged pollutants from its mine into Hawk Inlet,
near Juneau, Alaska, at concentrations in excess of those allowed by
its National Pollutant Discharge Elimination System permit. The Consent
Decree requires Greens Creek to continue operation of a wastewater
treatment system at the mine. The Consent Decree also requires Greens
Creek to pay a civil penalty of $300,000.
The Department of Justice will receive, for a period of thirty (30)
days from the date of this publication, comments relating to the
proposed consent decree. Comments should be addressed to the Assistant
Attorney General for the Environment and Natural Resources Division,
Department of Justice, Washington, D.C. 20530, and should refer to
United States v. Kennecott Greens Creek Mining Company, DOJ Ref. #90-5-
1-1-4346.
The proposed consent decree may be examined at the office of the
United States Attorney, Federal Bldg. & U.S. Courthouse, 222 W. 7th
Ave., Anchorage AK 99513, the Region 10 Office of the Environmental
Protection Agency, 1200 Sixth Ave., Seattle, WA 98101, and at the
Consent Decree Library, 1120 G Street, N.W., 4th Floor, Washington,
D.C. 20005, (202) 624-0892. A copy of the proposed consent decree may
be obtained in person or by mail from the Consent Decree Library, 1120
G Street, N.W., 4th Floor, Washington, D.C. 20005. In requesting a copy
please refer to the referenced case and enclose a check in the amount
of $5.75 (25 cents per page reproduction costs), payable to the Consent
Decree Library.
