Description of Project: The proposed closed-loop Johnson Canyon Energy Project would consist of: (1) a 50-foot-high, 400-foot-long dam forming a 20-acre upper reservoir with a storage capacity of 1,000 acre-feet; (2) a 50-foot-high, 450-foot-long dam forming a 25-acre lower reservoir with a storage capacity of 1,250 acre-feet; (3) underground tunnels connecting the upper and lower reservoirs consisting of: (a) two, 10-foot diameter parallel pipes with a length of 7,500-feet each; (b) two 10-foot diameter, 100-foot-high vertical shafts; (c) a 25-foot diameter, 200-foot-long pump intake tunnel located in the lower reservoir ; (4) a reinforced concrete and steel powerhouse containing two 50 megawatt (MW) reversible pump-turbines for a total installed capacity of 100 MW; and (5) appurtenant facilities. The proposed project would connect to the Rocky Mountain Power system at the Josephson substation via a new 1.6-mile overhead transmission line.

When a Declaration of Intention is filed with the Federal Energy Regulatory Commission, the Federal Power Act requires the Commission to investigate and determine if the project would affect the interests of interstate or foreign commerce. The Commission also determines whether or not the project: (1) would be located on a navigable waterway; (2) would occupy public lands or reservations of the United States; (3) would utilize surplus water or water power from a government dam; or (4) would be located on a non-navigable stream over which Congress has Commerce Clause jurisdiction and would be constructed or enlarged after 1935.

In determining the appropriate action to take, the Commission will consider all protests or other comments filed, but only those who file a motion to intervene in accordance with the Commission's Rules may become a party to the proceeding.
