In accordance with Departmental policy, 28 CFR 50.7, notice is
hereby given that a proposed partial consent decree in United States v.
New York City Board of Education, et al., Civil Action No. 89-0856, was
lodged on April 14, 1994 with the United States District Court for the
Eastern District of New York. Defendant New York City Board of
Education (New York) owns and operates schools in the New York City
metropolitan area. New York contracted with Defendants Hollywood

National Emission Standards for Hazardous Air Pollutants (NESHAPS) for
asbestos. Under the terms of the proposed partial consent decree,
Hollywood and Grgas will pay civil penalties in the amounts of $3,500
and $1,500, respectively and agree to be enjoined from further
violations of the Act and the NESHAPS.
The Department of Justice will receive, for a period of thirty (30)
days from the date of this publication, comments relating to the
proposed consent decree. Comments should be addressed to the Assistant
Attorney General for the Environment and Natural Resources Division,
Department of Justice, Washington, DC 20530, and should refer to United
States v. New York City Board of Education, et al., D.J. reference #90-
5-2-1-1300.
