Notice of Limitation on Claims for Judicial Review of Actions by the California Department of Transportation (Caltrans), pursuant to 23 U.S.C. 327, and U.S. Army Corps of Engineers (USACE), U.S. Fish and Wildlife Service (USFWS), Environmental Protection Agency (EPA) and the Natural Resource Conservation Service (NRCS).

SUMMARY:

The FHWA, on behalf of Caltrans, is issuing this notice to announce actions taken by Caltrans, USACE, USFWS, EPA and NRCS that are final within the meaning of 23 U.S.C. 139(l)(1). The actions relate to a proposed highway project, on State Route 156 from 0.18 mile east of the State Route 156/183 Separation to the U.S. Route 101/State Route 156 and on U.S. Route 101 from 0.1 mile north of Pesante Road to 0.2 mile north of Messick Road in Monterey County, State of California. Those actions grant licenses, permits, and approvals for the project.

DATES:

By this notice, the FHWA, on behalf of Caltrans, is advising the public of final agency actions subject to 23 U.S.C. 139(l)(1). A claim seeking judicial review of the Federal agency actions on the highway project will be barred unless the claim is filed on or before September 28, 2013. If the Federal law that authorizes judicial review of a claim provides a time period of less than 150 days for filing such claim, then that shorter time period still applies.

SUPPLEMENTARY INFORMATION:

Effective July 1, 2007, the FHWA assigned, and Caltrans assumed environmental responsibilities for this project pursuant to 23 U.S.C. 327. Notice is hereby given that the Caltrans and other Federal agencies have taken final agency actions subject to 23 U.S.C. 139(l)(1) by issuing licenses, permits, and approvals for the following highway project in the State of California: The six mile project would widen State Route 156 by converting the existing two-lane conventional highway to a four-lane expressway between U.S. Route 101 and Castroville Boulevard, and rebuilding the U.S. Route 101/State Route 156 interchange near Castroville in Monterey County, California. The proposed project would improve safety and operations, local road access to State Route 156, interregional traffic flow along State Route 156 and relieve existing congestion. The actions by the Federal agencies, and the laws under which such actions were taken, are described in the Environmental Assessment (EA)/Finding of No Significant Impact (FONSI) for the project, approved on January 31, 2013, and in other documents in the FHWA project records.
