Receipt of a Notification To Conduct Small-Scale Field Testing;
Genetically-Altered Microbial Pesticide
AGENCY: Environmental Protection Agency.
ACTION: Notice.

SUMMARY: EPA has received from AgriVirion Inc., of New York, a
notification of intent to conduct a small-scale field test involving
the genetically-altered (polyhedrin-minus) Autographa californica
nuclear polyhedrosis virus (ACNPV). AgriVirion intends to test the
pesticide on cabbage in New York. The target pest for these field
trials is the cabbage looper.
DATES: Written comments must be received on or before June 15, 1994.

Information submitted in any comment(s) concerning this notice may
be claimed confidential by marking any part or all of that information
as ``Confidential Business Information'' (CBI). Information so marked,
will not be disclosed except in accordance with procedures set forth in
40 CFR part 2. A copy of the comment(s) that does not contain CBI must
be submitted for inclusion in the public record. Information not marked
confidential may be disclosed publicly by EPA without prior notice to
the submitter. Information on the proposed test and all written
comments will be available for public inspection in Rm. 246 at the
Virginia address given above, from 8 a.m. to 4 p.m., Monday through
Friday, excluding legal holidays.

Supplementary Information: A notification of intent to conduct small-
scale field testing pursuant to EPA's Statement of Policy entitled,
``Microbial Products Subject to the Federal Insecticide, Fungicide, and
Rodenticide Act and the Toxic Substances Control Act,'' published in
the Federal Register of June 26, 1986 (51 FR 23313), has been received
from AgriVirion Inc. of New York. The purpose of the proposed testing
is to evaluate the efficacy of the genetically-altered AcNPV under
field conditions on cabbage in New York. The target pest for these
field trials is the cabbage looper. A 2 acre test site will be treated
twice this growing season; all treated crops will be destroyed.
Following the review of AgriVirion's application and any comments
received in response to this Notice, EPA will decide whether or not an
experimental use permit is required.
