Distler, Civil Action Nos. C-88-0200-L(A) and C-88-0201-L (A), was
lodged on April 26, 1994 with the United States District Court for the
Western District of Kentucky. The proposed Consent Decree concerns an
abandoned brickyard and a farm located in Hardin and Jefferson

the Complaint in this action seeks recovery of all past response costs
incurred by the United States at the sites. Under the proposed Consent
Decree, the settling defendants and third-party defendants will pay in
excess of 83 percent of EPA's past response costs and all future
response costs to be incurred at the sites.
