Berenergy Corporation; Denver, CO; Affirmative Determination 
Regarding Application for Reconsideration

    On April 14, 1994, one of the petitioners requested administrative 
reconsideration of the Department's denial notice for workers at the 
subject firm. The Department's Negative Determination was issued on 
March 15, 1994 and was published in the Federal Register on March 30, 
1994 (59 FR 14876).
    The petitioner, with the support of the company, stated that the 
company is a producer and produces crude oil and natural gas.

Conclusion

    After careful review of the application, I conclude that the claim 
is of sufficient weight to justify reconsideration of the Department of 
Labor's prior decision. The application is, therefore, granted.
