ACTION:
Proposed rule.
SUMMARY:
The Environmental Protection Agency (EPA) is proposing to approve State Implementation Plan (SIP) revisions submitted by the state of Montana on September 8, 2016. The revisions are to the Administrative Rules of Montana (ARM) and include updates to the citations and references to federal and state laws and regulations, updated links to sources of information, and provides clarity on how copies of federal regulations may be obtained. In the “Rules and Regulations” section of this Federal Register, we are approving these SIP revisions as a direct final rule without prior proposed rule. If we receive no adverse comment, we will not take further action on this proposed rule. This action is being taken in accordance with section 110 of the Clean Air Act (CAA).

In the “Rules and Regulations” section of this Federal Register, the EPA is approving the State's SIP revisions as a direct final rule without prior proposal because the Agency views these as noncontroversial SIP revisions and anticipates no adverse comments. In this proposed rule, the EPA is proposing regulatory text that includes incorporation by reference. In accordance with requirements of 1 CFR 51.5, the EPA is proposing to incorporate by reference the date of the version of the federal regulations regarding air quality rules into the ARM. A detailed rationale for the approval is set forth in the preamble to the direct final rule.
If the EPA receives no adverse comments, the EPA will not take further action on this proposed rule. If the EPA receives adverse comments, we will withdraw the direct final rule and it will not take effect. The EPA will address all public comments in a subsequent final rule based on this proposed rule. The EPA will not institute a second comment period on this action. Any parties interested in commenting must do so at this time. For further information, please see the ADDRESSES section of this notice. Please note that if the EPA receives adverse comment on an amendment, paragraph, or section of this rule and if that provision may be severed from the remainder of the rule, the EPA may adopt as final those provisions of the rule that are not the subject of an adverse comment.
