Proposed CERCLA Prospective Purchaser Agreement for the Jomarc
Property
AGENCY: Environmental Protection Agency.
ACTION: Proposal of CERCLA Prospective Purchaser Agreement for the
Jomar Property of the Kysor Industrial Corporation superfund site and
the Northernaire Plating Company superfund site.

Summary: In accordance with the Comprehensive Environmental Response,
Compensation, and Liability Act of 1980 (CERCLA), 42 U.S.C. 9601 et
seq., as amended by the Superfund Amendments and Reauthorizations Act
of 1986 (SARA), Pub. L. 99-499, notification is hereby given that a
proposed prospective purhchaser agreement (PPA) for the Jomarc Property
which is within the boundaries of the Kysor Industrial Corporation
Superfund Site and the Northernaire Plating Company Superfund Site
located in Cadillac, Michigan, has been executed by R. Walker
Construction Co. The proposed PPA has been submitted to the Attorney
General for approval. The proposed PPA would resolve certain potential
claims of the United States under sections 106 and 107 of CERCLA, 42
U.S.C. Sections 9606, and 9607, against R. Walker Construction Co. The
proposed PPA would require R. Walker Construction Co. to remove an
underground storage tank and to remediate two areas of soil
contamination with the oversight of the Michigan Department of
Environmental Quality. The Jomarc Property is not on the National
Priorities List (NPL), but is within the boundaries of the Kysor

Industrial Corporation Superfund Site and the Northernaire Plating
Company Superfund Site both of which are listed on the NPL. The
construction of the Remedial Action is complete at those Sites and no
further response actions are contemplated at this time.
DATES: Comments on the proposed PPA must be received by EPA within June
22, 1998.
