    the Comprehensive Environmental Response, Compensation and Liability 
    Act of 1980, as Amended by the Superfund Amendments and Reauthorization 
    Act
    
    AGENCY: Environmental Protection Agency.
    
    ACTION: Notice; Request for public comment.

    SUMMARY: Notice is hereby given that a proposed prospective purchaser 
    agreement associated with Calhoun Park Area Superfund Site in 
    Charleston County, South Carolina was executed by the Agency on May 9, 
    1996, and executed by the Department of Justice on May 19, 1996. This 
    agreement is subject to final approval after the comment period. The 
    Prospective Purchaser Agreement would resolve certain potential EPA 
    claims under sections 106 and 107 of the Comprehensive Environmental 
    Response, Compensation and Liability Act of 1980, as Amended by the 
    Superfund Amendments and Reauthorization Act of 1986 (``CERCLA''), 
    against the South Carolina State Ports Authority, the prospective 
    purchaser (``the purchaser''). The settlement would require the 
    purchaser to provide for proper disposal of any wastes, debris, or 
    other materials generated by a proposed railroad realignment over a 
    portion of the Calhoun Park Area Site within 90 days for any wastes so 
    generated, and to provide EPA access to the Site.
    
        For thirty (30) days following the date of publication of this 
    notice, the Agency will receive written comments relating to the 
    proposed settlement. The Agency's response to any comments received 
    will be available for public inspection at the U.S. Environmental 
    Protection Agency, Region 4, 345 Courtland St., N.E., Atlanta, Georgia 
    30365.
    
    DATES: Comments must be submitted on or before July 11, 1996.
    
    AVAILABILITY: The proposed settlement is available for public 
    inspection at the U.S. Environmental Protection Agency, Region 4, 345 
    Courtland St., N.E., Atlanta, Georgia 30365. A copy of the proposed 
    agreement may be obtained from Bernie Hayes, Remedial Project Manager, 
    U.S. Environmental Protection Agency, Region 4, 345 Courtland St., 
    N.E., Atlanta , Georgia 30365. Comments should reference the ``Calhoun 
    Park Area Superfund Site Prospective Purchaser Agreement'' and should 
    be forwarded to Bernie Hayes, Remedial Project Manager, at the above 
    address.
