The Commission will consider and act upon the following in open session: Secretary of Labor v. Jim Walter Resources, Inc., Docket Nos. SE 2008-881, et al. (Issues include whether the Administrative Law Judge erred by assessing a civil penalty that was substantially lower than the proposed penalty.) The public meeting originally scheduled at this time for Secretary of Labor v. Emerald Coal Resources, Docket No. PENN 2009-697, and consolidated cases has been postponed.
