    SUMMARY:

    The Food and Drug Administration (FDA or we) is extending the comment period for the draft guidance entitled “Questions and Answers About Dietary Guidance Statements in Food Labeling: Draft Guidance for Industry,” that appeared in the Federal Register of March 27, 2023. We are taking this action in response to requests for an extension to allow interested persons additional time to submit comments.

    DATES:

    FDA is extending the comment period on the draft guidance published March 27, 2023 (88 FR 18149). Submit either electronic or written comments on the draft guidance by September 25, 2023, to ensure that we consider your comment on the draft guidance before we begin work on the final version of the guidance.

    SUPPLEMENTARY INFORMATION:

    In the Federal Register of March 27, 2023 (88 FR 18149), we published a notice of availability for a draft guidance entitled “Questions and Answers About Dietary Guidance Statements in Food Labeling: Draft Guidance for Industry.” This action opened a docket with a 90-day comment period. Start Printed Page 39257

    We have received requests for a 90-day extension of the comment period for the draft guidance. We have concluded that it is reasonable to extend the comment period for 90 days, until September 25, 2023. (A 90-day extension would fall on September 24, 2023, which is a Sunday, so we have extended the comment period until the next business day, which is September 25, 2023.) We believe that the additional time allows adequate time for interested persons to submit comments.
