Notice of Commission Determination Not To Review an Initial
Determination Finding Three Respondents To Be in Default
AGENCY: U.S. International Trade Commission.
ACTION: Notice.

SUMMARY: Notice is hereby given that the U.S. International Trade
Commission had determined not to review the initial determination (ID)
of the presiding administrative law judge (ALJ) in the above-captioned
investigation finding respondents Tractor Company, Sonica Trading, Inc.
(Sonica Trading), and Toyo Service Co., Ltd. (Toyo Service) in default,
and to have waived their respective rights to appear, to be served with
documents, and to contest the allegations at issue in the
investigation.

SUPPLEMENTARY INFORMATION: Neither Tractor Company, Sonica Trading, nor
Toyo Service filed a response to the notice of investigation or the
complaint, a discovery statement, a target date statement, or responses
to complainants' discovery requests. On April 8, 1996, complainants
Kubota Tractor Corporation, Kubota Manufacturing of America
Corporation, and Kubota Corporation moved that Tractor Company, Sonica
Trading, and Toyo Service be ordered to show cause why they should not
be found in default, and if they failed to make such a showing, that an
ID be issued finding them to be in default. On April 17, 1996, the ALJ
ordered the subject respondents to show cause no later than May 3,
1996, why each should not be found in default (Order No. 8). None of
the three respondents filed a response to the order. Accordingly, on
May 8, 1996, the ALJ issued an ID (Order No. 13) finding Tractor
Company, Sonica Trading, and Toyo Service in default pursuant to
Commission final rule 210.16, and ruling that they had waived their
respective rights to appear, to be served with documents, and to
contest the allegations at issue in the investigation. No petitions for
review of the ID were received.
This action is taken under the authority of section 337 of the
Tariff Act of 1930, as amended (19 U.S.C. Sec. 1337), and section
210.42 of the Commission's final Rules of Practice and Procedure (19
CFR Sec. 210.42).
Copies of the ID and all other nonconfidential documents filed in
connection with this investigation are available for inspection during
official business hours (8:45 a.m. to 5:15 p.m.) in the Office of the
Secretary, U.S. International Trade Commission, 500 E Street, S.W.,
