DEPARTMENT OF JUSTICE
Lodging of Consent Decree Pursuant to the Comprehensive
Environmental Response, Compensation and Liability Act
In accordance with Departmental policy, notice is hereby given that
on June 1, 1994, the United States Department of Justice, by the
authority of the Attorney General and acting at the request of and on
behalf of the Administrator of the United States Environmental
Protection Agency, lodged a Consent Decree in United States v. St.
Pierre Co., Inc., et al., C.A. No. 94-4106-JF7 with the United States
District Court for the Southern District of Illinois.
The Consent Decree addresses the liability of Defendants for
response costs the United States incurred in responding to the release
and threatened release of hazardous substances at the M.T. Richards,
Inc. site in Crossville, Indiana, in this action brought pursuant to
the Comprehensive Environmental Response, Compensation, and Liability
Act (``CERCLA''), 42 U.S.C. Section 9607. The Decree calls for the
payment of $27,127.55 from Defendants, who allegedly arranged for
disposal or treatment of hazardous substances, or arranged with a
transporter for transport for disposal or treatment of hazardous
substances at the M.T. Richards, Inc. site.
The Department of Justice will receive, for a period of thirty (30)
days from the date of this publication, comments relating to the
Consent Decree. Comments should be addressed to the Assistant Attorney
General for the Environment and Natural Resources Division, Department
of Justice, Washington, DC 20530, and should refer to United States v.
St. Pierre Co., Inc., DOJ Reference No. 90-11-3-1112C.
The Consent Decree may be examined at the Office of the United
States Attorney for the Southern District of Illinois, Suite 300, 9
Executive Drive, Fairview Heights, Illinois 52258; or at the Consent
Decree Library, 1120 G Street, NW., 4th Floor, Washington, DC 20005
(202) 624-0892. A copy of the Consent Decree may be obtained in person
or by mail from the Consent Decree Library. In requesting a copy,
please enclose a check for $6.25 (25 cents per page reproduction cost)
