    Collection of Fee for Processing Garnishment of Department of 
    State Employees for Payment of Debt
    
    AGENCY: Department of State.
    
    ACTION: Notice.

    SUMMARY: The Department of State is giving notice that, as authorized 
    by title 5 United States Code, section 5520a(j)(2), it will collect and 
    use a fee for processing of garnishments against Department of State 
    employees to satisfy debts other than for alimony or child support. The 
    fee is $30, and it will be collected from the employee at the time the 
    garnishment is first instituted. It will be added to the amount 
    garnished as a charge against salary.
    
    EFFECTIVE DATE: Pay period beginning July 2, 1995.

    SUPPLEMENTARY INFORMATION: The law permitting garnishment to satisfy 
    debts also authorizes government agencies to collect a fee for such 
    garnishments. Based upon a cost study, the Department of State has 
    decided to impose a fee of $30.00 for receipt and processing of each 
    garnishment. As required by the law, this fee will be charged to the 
    employee whose salary is being garnished.
        The fee will be charged for each garnishment order served and 
    processed. Thus, each time a court or other institution orders the 
    Department to garnish an employee's salary, the Department will deduct 
    the $30.00 fee. Although administrative costs are incurred for each pay 
    period for which a garnishment is in effect, no additional fee will be 
    charged to cover those costs.
        The fee will deducted at the time the garnishment is first 
    instituted. It will be added to the garnishment amount, except that, in 
    cases where the garnishment amount plus the fee would exceed the 
    statutory garnishment limit, the garnishment amount will be reduced to 
    keep the total within that limit.
        The fee does not apply to garnishments for child support or alimony 
    under title 42 of the United States Code, sections 659, 661, and 662.
