Notice of Lodging of Consent Decree Pursuant to the Comprehensive
Environmental Response Compensation and Liability Act of 1980 as
Amended
In accordance with Department of Justice policy, 28 C.F.R. 50.7,
notice is hereby given that a proposed consent decree in United States
v. Freeman, et al., Civil No. 86-CV-748A, was lodged on June 17, 1996,
with the United States District Court for the Western District of New
York. The decree resolves claims against Garlock, Inc. and Unisys Corp.
in the above-referenced action under the Comprehensive Environmental
Response, Compensation, and Liability Act (``CERCLA'') for
contamination at the Byron Barrel and Drum Superfund Site in Genesee
County, New York (the ``Site''). In the proposed consent decree, the
settling defendants agree to reimburse the Environmental Protection

Agency (``EPA'') for $1,250,000 in past response costs incurred by EPA
at the Site, pay up to $250,000 in oversight costs, and perform the
remedial design and remedial action at the Site.
The Department of Justice will receive, for a period of thirty (30)
days from the date of this publication, comments relating to the
proposed consent decree. Comments should be addressed to the Assistant
Attorney General for the Environment and Natural Resources Division,
Department of Justice, Washington, D.C. 20530, and should refer to
United States v. Freeman, et al., DOJ Ref. Number 90-11-2-139.
The proposed consent decree may be examined at the Office of the
United States Attorney, 138 Delaware Avenue, Buffalo, New York 14202;
the Region II Office of the Environmental Protection Agency, 290
Broadway, New York, NY 10278; and the Consent Decree Library, 1120 G
Street, N.W., 4th Floor, Washington, D.C. 20005, (202) 624-0892. A copy
of the proposed consent decree may be obtained in person or by mail
from the Consent Decree Library. In requesting a copy, please refer to
the referenced case and enclose a check in the amount of $22 for the
Consent Decree without the attachments or $77.50 for the Consent Decree
with the attachments (25 cents per page reproduction costs), payable to
the Consent Decree Library.
