DEPARTMENT OF JUSTICE
Notice of Lodging of Consent Decree Pursuant to the Comprehensive
Environmental Response, Compensation, and Liability Act
Notice is hereby given that a proposed Consent Decree in United
States of America v. Braselman Corporation, et al., Civil Action No.
96-0872 was lodged on June 13, 1996 with the United States District
Court for the Eastern District of Louisiana.
In its Third Amended Complaint, filed concurrently with the United
States District Court for the Eastern District of Louisiana, the United
States alleges under Section 107 of the Comprehensive Environmental
Response, Compensation and Liability Act (``CERCLA''), 42 U.S.C. 9607,
that the defendants are liable for reimbursement of response costs
incurred and to be incurred by the United States at the Bayou Bonfouca
Superfund Site (``Site'') located in the City of Slidell, St. Tammany
Parish, Louisiana.
Under the proposed Consent Decree, Kerr-McGee Chemical Corporation
and Kerr-McGee Corporation, two of the eight defendants listed in the
Third Amended Complaint, have agreed to pay the EPA Hazardous Substance
Superfund $20,000,000 in reimbursement of past and future response
costs. The total cost of the cleanup, which is nearly complete, is
estimated at more than $100,000,000. The proposed Consent Decree
between the United States, Kerr-McGee Chemical Corporation, and Kerr-
McGee Corporation does not resolve the potential liability of the other
six defendants at the Site.
The Department of Justice will receive, for a period of thirty (30)
days from the date of this publication, comments relating to the
proposed Consent Decree. Comments should be addressed to the Assistant
Attorney General for the Environment and Natural Resources Division,
