Background
On September 14, 2009, the Department of Commerce (Commerce) published the antidumping duty order on certain kitchen appliance shelving and racks from China.[1] On February 3, 2020, Commerce initiated the second sunset review of the Order pursuant to 751(c) of the Tariff Act of 1930, as amended (the Act).[2] Commerce received a notice of intent to participate from domestic interested parties, Nashville Wire Products, Inc. (Nashville Wire) and SSW Holding Company, LLC (SSW), within the deadline specified in 19 CFR 351.218(d)(1)(i).[3] Both Nashville Wire and SSW claimed interested party status under section 771(9)(C) of the Act as producers of the domestic like product. On March 4, 2020, Commerce received a substantive response from Nashville Wire and SSW within the 30-day deadline specified in 19 CFR 351.218(d)(3)(i).[4] Commerce received no substantive responses from respondent interested parties, nor was a hearing requested. On March 24, 2020, Commerce notified the U.S. International Trade Commission (ITC) that it did not receive an adequate substantive response from respondent interested parties.[5] As a result, pursuant to section 751(c)(3)(B) of the Act and 19 CFR 351.218(e)(1)(ii)(C)(2), Commerce conducted an expedited (120-day) sunset review of the Order.
Scope of the Order
The product covered by the Order consists of shelving and racks for refrigerators, freezers, combined refrigerator-freezers, other refrigerating or freezing equipment, cooking stoves, ranges, and ovens (“certain kitchen appliance shelving and racks” or “the merchandise under order”). —Shelving and racks with dimensions: ranging from 3 inches by 5 inches by 0.10 inch to 28 inches by 34 inches by 6 inches; or

The merchandise under order is comprised of carbon or stainless steel wire ranging in thickness from 0.050 inch to 0.500 inch and may include sheet metal of either carbon or stainless steel ranging in thickness from 0.020 inch to 0.2 inch. The merchandise under order may by coated or uncoated and may by formed and/or welded. Excluded from the scope of this order is shelving in which the support surface is glass.
