MATTERS TO BE CONSIDERED: The Commission will consider and act upon the
following:
1. Secretary of Labor v. Peabody Coal Co., Docket No. KENT 93-369
(Issues include whether substantial evidence supports the judge's
determination that the operator's violation of 30 C.F.R. Sec. 75.601
was not significant and substantial).

MATTERS TO BE CONSIDERED: The Commission will consider and act upon the
following:
1. Secretary of Labor v. Topper Coal Co., Docket No. KENT 94-944-R
(Issues include whether the judge correctly determined that the
operator violated 30 U.S.C. Sec. 813(a) by impeding a spot inspection
for smoking materials, that the violation was significant and
substantial and the result of high negligence, and that a civil penalty
of $5,000 was appropriate).

MATTERS TO BE CONSIDERED: The Commission will consider and act upon the
following:
1. Secretary of Labor v. Consolidation Coal Co., et al., Docket No.
WEVA 94-377 (Issues include whether substantial evidence supports the
judge's conclusions that the operator's bleeder system met the
requirements of 30 C.F.R. Sec. 75.334(b)(1) and that the two individual
respondents were not liable under section 110(c) of the Mine Act for
knowingly authorizing a violation of that regulation, and whether to
remand for decision the issue of whether an allegedly incomplete cross-
sectional reading violated 30 C.F.R. Sec. 75.364(a)(2)).
TIME AND DATE: 10:00 a.m., Thursday, July 10, 1997.
PLACE: Room 6005, 6th Floor, 1730 K Street, N.W., Washington, D.C.
STATUS: Open.
MATTERS TO BE CONSIDERED: The Commission will consider and act upon the
following:
1. Secretary of Labor v. Thunder Basin Coal Co., Docket No. WEST 94-370
(Issues include whether the judge erred by failing to assess a separate
penalty for the operator's violation of 30 C.F.R. Sec. 40.4 and whether
the judge correctly applied the penalty assessment criteria of section
110(i) of the Mine Act in assessing a daily penalty for the operator's
failure to timely abate that violation).
Any person attending a meeting who requires special accessibility
features and/or auxiliary aids, such as sign language interpreters,
must inform the Commission in advance of those needs. Subject to 29
C.F.R. Sec. 2706.150(a)(3) and Sec. 2706.160(d).
