Notice of Lodging of Consent Decree Comprehensive Environmental
Response Compensation and Liability Act
Notice is hereby given that on June 29, 1999, a proposed Consent
Decree in United States v. Robert Neal Civil Action No. 1: 99-0264-08
was lodged with the United States District Court for the District of
South Carolina. The Consent Decree represents a settlement with one of
the potential responsible parties listed in the Amended Complaint for
violations of Section 107 of the Comprehensive Environmental Response,
Compensation and Liability Act of 1980, 42 U.S.C. 9607. Under the
Consent Decree, Robert Neal has agreed to pay the United States
$300.000. This Consent Decree represents the second settlement to be
lodged with the Court regarding the Clearwater Finishing Superfund
Site. The United States has incurred approximately $1,182,000.00. The
Amended Complaint names two additional parties.
The Department of Justice will receive for a period of thirty (30)
days from the date of this publication comments relating to the Consent
Decree. Comments should be addressed to the Assistant Attorney General
of the Environment and Natural Resources Division, Department of
Justice, Washington, DC 20530, and should refer to United States v.
Robert Neal, D.J. Ref. Number 90-11-3-06135.
The proposed Consent Decree may be examined at the Office of the
United States Attorney, for the District of South Carolina, First Union
Building, 1441 Main Street, Suite 500, Columbia, South Carolina 29201,
at U.S. EPA Region IV, 61 Forsyth Street, Atlanta, Georgia 30303, and
at the Consent Decree Library, 1120 G Street, NW., 3rd Floor,
Washington, DC 20005, (202) 624-0892. A copy of the proposed Consent
Decree may be obtained in person or by mail from the Consent Decree
Library, 1120 G Street, NW., 3rd Floor, Washington, DC 20005. In
requesting a copy, please enclose a check in the amount of $4.75 (25
cents per page reproduction cost) payable to the Consent Decree
Library.
