Notice of Lodging of Consent Decree Under the Clean Air Act
Pursuant to 28 CFR 50.7, notice is hereby given that on June 29,
1998, a proposed Consent Decree in United States v. Michigan Department
of Transportation, Civil Action No. 98-72712 was lodged with the United
States District Court for the Eastern District of Michigan.
The United States has asserted, in a civil complaint under the
Comprehensive Environmental Response, Compensation and Liability Act,
42 U.S.C. 9601 et seq., that the Michigan Department of Transportation
is a potentially responsible party at the Clare Water Supply Superfund
Site in the City of Clare, Clare County, Michigan.
Under the proposed Consent Decree, the Michigan Department of
Transportation has agreed to pay $150,000.00 to the Hazardous Waste
Superfund, representing its share of responsibility at the Site and an
appropriate premium.
The Department of Justice will receive for a period of thirty (30)
days from the date of this publication comments relating to the Consent
Decree. Comments should be addressed to the Assistant Attorney General
of the Environment and Natural Resources Division, Department of
Justice, Washington, D.C. 20530, and should refer to United States v.
Michigan Department of Transportation, Civil Action No. 98-72712, D.J.
Ref. 90-11-2-1212/1.
The Consent Decree may be examined at the Office of the United
States Attorney for the Eastern District of Michigan, 211 West Fort
Street, Suite 2001, Detroit, MI 48226-3211; at the Region 5
Environmental Protection Agency Library, Reference Desk, 77 W. Jackson
Boulevard, Chicago, Illinois 60604; and at the Consent Decree Library,
1120 G Street, N.W., 4th Floor, Washington, D.C. 20005, 202-624-0892. A
copy of the Consent Decree may be obtained in person or by mail from
the Consent Decree Library, 1120 G Street, N.W., 4th Floor, Washington,
D.C. 20005. In requesting a copy, please enclose a check in the amount
of $5.75 (25 cents per page reproduction cost) payable to the Consent
Decree Library.
