AGENCY: Federal Communications Commission.
ACTION: Proposed rule.

SUMMARY: The document requests comments on a petition filed by Douglas
A. Maszka, d/b/a Tri-Cities Television Company, requesting the
substitution of Channel *25+ for vacant Channel *17+ at Iron Mountain,
Michigan, allotment of channel 17- at Wittenberg, Wisconsin, and
allotment of channel 31+ at Menominee, Michigan. Since alternate
channels are available for Wittenberg and Menominee that do not require
a substitution at Iron Mountain, we shall propose the allotment of
Channel 25+ at Menominee, Michigan, with a site restriction 17.8
kilometers north at coordinates 45-16-00 and 87-36-48 and the allotment
of channel 46 at Wittenberg, Wisconsin, with a site restriction 30.7
kilometers north at coordinates 45-05-53 and 89-07-31. In the
alternative, we shall also propose, as requested by petitioner, the
allotment of channel 31+ at Menominee, Michigan, at coordinates 45-16-
00 and 87-36-48, the substitution of Channel *25+ for vacant Channel
*17+ at Iron Mountain, Michigan, at coordinates 45-49-12 and 88-04-31,
and the allotment of Channel 17- to Wittenberg, Wisconsin, at
coordinates 45-05-00 and 89-10-06. We shall also change the offset for
vacant Channel *17 at Ely, Minnesota, from minus to plus at coordinates
47-54-06 and 91-51-48 to accommodate Channel 17- at Wittenberg. Since
Menominee, Wittenberg, Iron Mountain and Ely are located within 400
kilometers (250 miles) of the U.S.-Canadian border, concurrence of the
Canadian government will be requested for these allotments.
DATES: Comments must be filed on or before September 6, 1994, and reply
comments on or before September 21, 1994.

Provisions of the Regulatory Flexibility Act of 1980 do not apply
to this proceeding.
