Notice of Lodging of Consent Decree Pursuant To The Comprehensive
Environmental Response, Compensation and Liability Act
Notice is hereby given that on June 17, 1997, a proposed Consent
Decree in United States v. Erie Coatings & Chemicals, Inc. et al.,
Civil No. 95-75842, was lodged with the United States District Court
for the Eastern District of Michigan. This Consent Decree resolves
claims against twenty-two (22) parties (``Settling Parties'') under the
Comprehensive Environmental Response, Compensation and Liability Act of
1980, as amended, 42 U.S.C. 9601 et seq. (``CERCLA'') relating to the
Erie Coatings & Chemicals, Inc. Superfund Site (``Site'') in Erie,
Michigan.
The Consent Decree requires the twenty-two (22) Settling Parties to
reimburse the Superfund in the amount of $950,000 for the United
States' past costs incurred in conducting a removal action at the Site.
The Department of Justice will receive for a period of thirty (30)
days from the date of this publication comments relating to the Consent
Decree. Comments should be addressed to the Assistant Attorney General
of the Environment and Natural Resources Division, Department of
Justice, Washington, D.C. 20530, and should refer in United States v.
Erie Coatings & Chemicals, Inc. et al., D.J. Ref. 90-11-2-1070.
The Consent Decree may be examined at the Office of the United
States Attorney, Eastern District of Michigan, 817 Federal Building,
231 West Lafayette, Detroit, Michigan 48226, and at the Consent Decree
Library, 1120 G Street, N.W., 4th Floor, Washington, D.C. 20005, (202)
624-0892. A copy of the proposed Consent Decree may be obtained in
person or by mail from the Consent Decree Library, 1120 G Street, N.W.,
4th Floor, Washington, D.C. 20005. In requesting a copy, please enclose
a check in the amount of $26.75 (25 cents per page reproduction cost)
payable to the Consent Decree Library.
