    National Emission Standards for Hazardous Air Pollutants for 
    Source Categories: National Emission Standards for Off-Site Waste and 
    Recovery Operations
    
    AGENCY: Environmental Protection Agency (EPA).
    
    ACTION: Proposed rule.

    SUMMARY: The EPA is taking direct final action to amend the national 
    emission standards for hazardous air pollutants (NESHAP) for off-site 
    waste and recovery operations (OSWRO) that the EPA promulgated on July 
    1, 1996, under authority of section 112 of the Clean Air Act (CAA). The 
    rule applies to owners and operators of facilities that are major 
    sources of hazardous air pollutants (HAP) and manage certain wastes, 
    used oil, or used solvents received from off-site locations. We are 
    proposing to amend specific provisions in the rule to resolve issues 
    and questions raised after promulgation of the final rule; correct 
    technical omissions; update specific requirements to be consistent with 
    recent decisions made by the Agency for other related air rules; and 
    correct typographical, printing, and grammatical errors.
        In the ``Rules and Regulations'' section of this Federal Register 
    publication, we are amending the OSWRO NESHAP as a direct final rule 
    without prior proposal because we view the amendments as 
    noncontroversial and anticipate no adverse comment. We have explained 
    our reasons for the amendments in the preamble to the direct final 
    rule. If we receive no adverse comment, we will not take further action 
    on this proposed rule. If we receive adverse comment, we will withdraw 
    the direct final rule and it will not take effect. We will address the 
    comments in a subsequent final rule based on the proposed rule. We will 
    not institute a second comment period on this action. Any parties 
    interested in commenting must do so at this time.
    
    DATES: Comments. Written comments must be received by August 19, 1999. 
    Additionally, a public hearing regarding the proposed amendments will 
    be held if anyone requesting to speak contacts the EPA by August 10, 
    1999. If a hearing is requested, the hearing will be held on August 19, 
    1999 beginning at 10:00 a.m., and the record on the hearing will remain 
    open for 30 days after the hearing date to provide an opportunity for 
    submittal of rebuttal and additional information.
