Take notice that on July 16, 2002, El Paso Electric Company (El Paso) amended its application requesting authorization to replace two outstanding series of Pollution Control Bonds with the following: (1) $37.1 million of Adjustable Tender Pollution Control Refunding Revenue Bonds, 1984 Series E, and (2) $33.3 million Adjustable Tender Pollution Control Refunding Revenue Bonds, 1994 Series A.

El Paso also requests a waiver from the Commission's competitive bidding and negotiated placement requirements at 18 CFR 34.2.

Any person desiring to be heard or to protest such filing should file a motion to intervene or protest with the Federal Energy Regulatory Commission, 888 First Street, NE., Washington, DC 20426, in accordance with Rules 211 and 214 of the Commission's Rules of Practice and Procedure (18 CFR 385.211 and 385.214). All such motions and protests should be filed on or before the comment date. Protests will be considered by the Commission to determine the appropriate action to be taken, but will not serve to make protestants parties to the proceedings.
