Notice of Lodging of Consent Decree Pursuant to the Comprehensive
Environmental Response Compensation and Liability Act
Notice is hereby given that a proposed consent decree in United
States v. Coon Refrigeration, et al., Civil Action No. 90-212 (W.D.
Pa.), was lodged on July 1, 1999 with the United States District Court
for the Western District of Pennsylvania. The United States filed its
action pursuant to the Comprehensive Environmental Response,
Compensation, and Liability Act to recover costs incurred and to be
incurred in cleaning up the Pagan Road Superfund Site in western
Pennsylvania. The proposed consent decree requires Marlin Coon and Coon
Refrigeration to pay a minimum of $1,002 in reimbursement of past
response costs incurred at the Site. The Consent Decree also requires
Marlin Coon and Coon Refrigeration to sell the Pagan Road Site and pay
seventy-five percent of the proceeds of that sale to the United States
in further reimbursement of past response costs.
The Department of Justice will receive, for a period of thirty (30)
days from the date of this publication, comments relating to the
proposed consent decree. Comments should be addressed to the Assistant
Attorney General for the Environment and Natural Resources Division,
Department of Justice, Washington, DC 20530, and should refer to United
States v. Coon Refrigeration, et al., DOJ Ref. #90-11-2-619.
The proposed consent decree may be examined at the office of the
United States Attorney, 100 State Street, Suite 302, Erie, PA 16507,
the Regional Office of the Environmental Protection Agency, 615 Arch
Street, Philadelphia, PA 19103, and at the Consent Decree Library, 1120
G Street, NW, 3rd Floor, Washington, DC 20005, (202) 624-0892. A copy
of the proposed consent decree may be obtained in person or by mail
from the Consent Decree Library, 1120 G Street, NW, 3rd Floor,
Washington, DC 20005. In requesting a copy please refer to the
referenced case and enclose a check in the amount of $4.00 for the
consent decree (25 cents per page reproduction costs), payable to the
Consent Decree Library.
