    Notice of Lodging of Consent Decree Under the Clean Water Act
    
        Under 28 CFR 50.7, notice is hereby given that on July 9, 1999, a 
    proposed Consent Decree in United States and the State of Ohio v. City 
    of Port Clinton, Civil Action Nos. 3:99CV7434 and 3:99CV7435, was 
    lodged with the United States District Court for the Northern District 
    of Ohio, Western Division.
        In these consolidated actions, the United States and the State of 
    Ohio sought injunctive relief and penalties against the City of Port 
    Clinton (``Port Clinton'') for claims arising in connection with Port 
    Clinton's wastewater treatment plant in Port Clinton, Ohio, under the 
    Clean Water Act, 33 U.S.C. 1251 et seq. Under the Consent Decree, Port 
    Clinton will engage in short-term compliance measures that include 
    inspecting and sampling a primary bypass outfall during periods of 
    operation, sampling at a public beach, and permanently improving or 
    closing all combined sewer overflow stations. Port Clinton's long-term 
    compliance measures include submitting plans and construction schedules 
    to eliminate primary bypassing, to disinfect and dechlorinate all 
    secondary bypasses, and to assure that effluent limitations will 
    continue to be met. Port Clinton also must submits a plan to study the 
    feasibility of eliminating secondary bypassing. Port Clinton will pay a 
    civil penalty of $60,000, one-half of which will be paid to the United 
    States,and the other half of which will be paid to Ohio.
        The Department of Justice will receive for a period of thirty (30) 
    days from the date of this publication comments relating to the Consent 
    Decree. Comments should be addressed to the Assistant Attorney General 
    of the Environment and Natural Resources Division, Department of 
    Justice, Washington, DC 20530, and should refer to United States and 
    State of Ohio v. City of Port Clinton, D.J. No. 90-5-1-1-4501.
        The Consent Decree may be examined at the Office of the United 
    States Attorney, Four Seagate, Suite 308, Toledo, Ohio, 43604-2624, at 
    the Region 5 Office of the United States Environmental Protection 
    Agency, 77 West Jackson Boulevard, Chicago, IL 60604-3590, and at the 
    Consent Decree Library, 1120 G Street, NW, 3rd Floor, Washington, DC 
    20005. A copy of the Consent Decree may be obtained in person or by 
    mail from the Consent Decree Library, 1120 G Street, NW, 3rd Floor, 
    Washington, DC 20005. In requesting a copy, please refer to the above-
    referenced case and enclose a check in the amount of $24.50 (25 cents 
    per page reproduction cost) payable to the Consent Decree Library.
