Amendment of Class E Airspace; Baker City, Oregon
AGENCY: Federal Aviation Administration (FAA), DOT.
ACTION: Final rule.

SUMMARY: This action amends the Baker City, Oregon, Class E airspace to
provide additional controlled airspace for Instrument Flight Rules
(IFR) operations at the Baker City Municipal Airport. Additionally,
this action corrects the airport name and referenced navigational aid
which were incorrectly stated in the previous legal description of the
Class E airspace area.

SUPPLEMENTARY INFORMATION:
History
On May 20, 1996, the FAA proposed to amend part 71 of the Federal
Aviation Regulations (14 CFR part 71) to amend Class E airspace at
Baker City, Oregon to provide additional controlled airspace for IFR
operations at Baker City Municipal Airport (61 FR 25157). A minor
correction is also being made to the airport name and navigational aid
name which were incorrectly referenced in the previous legal
description of the Class E airspace area. Interested parties were
invited to participate in the rulemaking proceeding by submitting
written comments on the proposal. No comments were received.
The coordinates for this airspace docket are based on North
American Datum 83. Class E airspace areas extending upward from 700
feet or more above the surface of the earth are published in paragraph
6005 of FAA Order 7400.9C dated August 17, 1995, and effective
September 16, 1995, which is incorporated by reference in 14 CFR 71.1.
The Class E airspace areas listed in this document will be published
subsequently in the Order.
The Rule
This amendment to part 71 of the Federal Aviation Regulations
amends Class E airspace at Baker City, Oregon. The FAA has determined
that this regulation only involves an established body of technical
regulations for which frequent and routine amendments are necessary to
keep them operationally current. It, therefore, (1) is not a
``significant regulatory action'' under Executive Order 12866; (2) is
not a ``significant rule'' under DOT Regulatory Policies and Procedures
(44 FR 11034; February 26, 1979); and (3) does not warrant preparation
of a regulatory evaluation as the anticipated impact is so minimal.
Since this is a routine matter that will only affect air traffic
procedures and air navigation, it is certified that this rule will not
have a significant economic impact on a substantial number of small
entities under the criteria of the Regulatory Flexibility Act.

In consideration of the foregoing, the FAA amends 14 CFR part 71 as
follows:

2. The incorporation by reference in 14 CFR 71.1 of the Federal
Aviation Administration Order 7400.9C, Airspace Designations and
Reporting Points, dated August 17, 1995, and effective September 16,
1995, is amended as follows:

feet or more above the surface of the earth.

That airspace extending upward from 1,200 feet above the surface
within 7 miles northeast and 5.3 miles southwest of the Baker City
VOR/DME 138 deg. and 317 deg. radials extending from 12.2 miles
southeast to 14 miles northwest of the VOR/DME, and within 8.7 miles
west and 4.3 miles east of the Baker City VOR/DME 345 deg. radial
extending from the VOR/DME to the south edge of V-298, and that
airspace east of Baker City VOR/DME bounded on the north by the
south edge of V-121, on the southeast by the northwest edge of V-
269, and on the southwest by the northeast edge of V-4-444;
excluding the Boise, ID, Enroute Domestic Airspace Area.
