Notice of Lodging of Consent Decree Pursuant to Clean Water Act
In accordance with Departmental Policy, 28 CFR 50.7, notice hereby
is given that a consent decree in United States v. Robert Brace and
Robert Brace Farms, Inc., No. 90-229 Erie, was lodged with the United
States District Court for the Western District of Pennsylvania on July
24, 1996.
The proposed consent decree concerns violations of sections 301 and
404 of the Clean Water Act, 33 U.S.C. 1311, 1344, as a result of
unpermitted discharges of dredged and fill material into portions of
property located in Erie County, Pennsylvania, that constitute ``waters
of the United States.'' The consent decree encompasses a permanent
injunction and requires defendants to perform restoration of the
violated thirty acres of wetlands and to pay a civil penalty of $10,000
to the U.S. Treasury.
The Department of Justice will receive written comments relating to
this consent decree for a period of thirty days from the date of
publication of this notice. Comments should be addressed to the
