Notice of Commission Determination Not To Review an Initial
Determination Terminating the Investigation on the Basis of a
Settlement Agreement; In the Matter of Certain Diagnostic Kits for the
Detection and Quantification of Viruses
AGENCY: U.S. International Trade Commission.
ACTION: Notice.

SUMMARY: Notice is hereby given that the U.S. International Trade
Commission has determined not to review the presiding administrative
law judge's (ALJ's) initial determination (ID) (Order No. 14) in the
above-captioned investigation terminating the investigation on the
basis of a settlement agreement.

SUPPLEMENTARY INFORMATION: This patent-based section 337 investigation
was instituted by the Commission on July 29, 1996, on behalf of
complainant Hoffmann-LaRoche, Inc. (Roche) of Nutley, New Jersey. 61 FR
39468. The

complaint alleged violations of section 337 of the Tariff Act of 1930
in the importation into the United States, the sale for importation,
and the sale within the United States after importation of certain
diagnostic test kits for the detection and quantification of viruses
that allegedly are covered claims 1, 2, 5-9, 11-12, 15, and 19 of U.S.
Letters Patent 5,476,774. The notice of investigation named Organon
Teknica B.V. of the Netherlands and Organon Teknika Corp. of Delaware
(collectively ``Teknica'') as respondents.
On April 23, 1997, complainant and respondents to the investigation
filed a joint motion to terminate the investigation as to all issues
based upon a settlement agreement. On July 14, 1997, the presiding ALJ
granted the joint motion and issued an ID (Order No. 14) terminating
the investigation on the basis of the settlement agreement. The ALJ
found that there is no indication that termination of the investigation
would have an adverse impact on the public interest and that
termination based on settlement is generally in the public interest. No
petitions for review were filed.
This action is taken under the authority of section 337 of the
Tariff Act of 1930, 19 U.S.C. 1337, and Commission rule 210.42, 19
C.F.R. 210.42.

nonconfidential documents filed in connection with this investigation,
are or will be available for inspection during official business hours
