Amendment and Establishment of Import Restraint Limits and
Restraint Periods for Certain Cotton and Wool Textile Products Produced
or Manufactured in Uruguay
August 22, 1995.

ACTION: Issuing a directive to the Commissioner of Customs amending and
establishing limits and restraint periods.

SUPPLEMENTARY INFORMATION:
Authority: Executive Order 11651 of March 3, 1972, as amended;
section 204 of the Agricultural Act of 1956, as amended (7 U.S.C.
1854).
Pursuant to the Uruguay Round Agreement on Textiles and Clothing
(ATC) and the Uruguay Round Agreements Act, the current restraint
period agreed upon by the Governments of the United States and Uruguay
is being amended and new limits are being established for the period
beginning on January 1, 1995 and extending through December 31, 1995.
Since Uruguay is now a member of the World Trade Organization (WTO),
the limits published in the Federal Register on December 20, 1994 (59
FR 65530) are being amended. Pursuant to the ATC, these new limits
supersede those notified to the TMB contained in the Bilateral Cotton
and Wool Textile Agreement, effected by exchange of notes dated
December 30, 1983 and January 23, 1984, as amended and extended,
between the Governments of the United States and Uruguay.
In the letter published below, the Chairman of CITA directs the
Commissioner of Customs to amend the current restraint period and
establish new limits for the period beginning on July 1, 1994 and
extending through December 31, 1994 and the period beginning on January
1, 1995 and extending through December 31, 1995.
A description of the textile and apparel categories in terms of HTS
numbers is available in the CORRELATION: Textile and Apparel Categories
with the Harmonized Tariff Schedule of the United States (see Federal
Register notice 59 FR 65531, published on December 20, 1994).
The letter to the Commissioner of Customs and the actions taken
pursuant to it are not designed to implement all of the provisions of
the ATC, but are designed to assist only in the implementation of
certain of its provisions.

Dear Commissioner: This directive amends, but does not cancel,
the directive issued to you on December 14, 1994, by the Chairman,
Committee for the Implementation of Textile Agreements. That
directive concerns imports of certain cotton and wool textile
products, produced or manufactured in Uruguay and exported during
the twelve-month period beginning on July 1, 1994 and extending
through June 30, 1995.
Effective on August 30, 1995, you are directed, pursuant to the
Uruguay Round Agreements Act and the Uruguay Round Agreement on
Textiles and Clothing (ATC), to amend the restraint period to end on
December 31, 1994 at the limits listed below. These limits supersede
those contained in the Bilateral Cotton and Wool Textile Agreement,
effected by exchange of notes dated December 30, 1983 and January
23, 1984, as amended and extended, between the Governments of the
United States and Uruguay.

Under the terms of section 204 of the Agricultural Act of 1956,
as amended (7 U.S.C. 1854), the Uruguay Round Agreements Act and the
Uruguay Round Agreement on Textiles and Clothing (ATC); and in
accordance with the provisions of Executive Order 11651 of March 3,
1972, as amended, you are directed to prohibit, effective on August
30, 1995, entry into the United States for consumption and
withdrawal from warehouse for consumption of cotton and wool textile
products in the following categories, produced or manufactured in
Uruguay and exported during the twelve-month period beginning on
January 1, 1995 and extending through December 31, 1995, in excess
of the following limits. These limits supersede those contained in
the Bilateral Cotton and Wool Textile Agreement, effected by
exchange of notes dated December 30, 1983 and January 23, 1984, as
amended and extended, between the Governments of the United States
and Uruguay.

Imports charged to these category limits for the period July 1,
1994 through December 31, 1994 shall be charged against those levels
of restraint to the extent of any unfilled

balances. In the event the limits established for that period have been
exhausted by previous entries, such goods shall be subject to the
levels set forth in this directive. Import charges will be provided
at a later date.
The limits set forth above are subject to adjustment in the
future pursuant to the provisions of the ATC and any administrative
arrangements between the Governments of the United States and
Uruguay.
In carrying out the above directions, the Commissioner of
Customs should construe entry into the United States for consumption
to include entry for consumption into the Commonwealth of Puerto
Rico.
The Committee for the Implementation of Textile Agreements has
determined that these actions fall within the foreign affairs
exception of the rulemaking provisions of 5 U.S.C. 553(a)(1).
