    CSX Transportation, Inc.--Trackage Rights Exemption--Norfolk and 
    Western Railway Company
    
        Norfolk and Western Railway Company (NW) has agreed to grant 
    overhead trackage rights to CSX Transportation, Inc. (CSXT) as follows: 
    from the connection track in the northwest quadrant between the tracks 
    of CSXT and NW at or near NW's milepost D122.6 at St. Joe, IN to the 
    southernmost connection between NW and the industrial trackage of Steel 
    Dynamics, Inc. (SDI) in Wilmington Township, DeKalb County, IN, at or 
    near NW's milepost D118.6, a total distance of approximately 3.5 miles. 
    The proposed transaction will allow CSXT to provide direct rail service 
    to SDI's mill, increase intramodal competition, and allow CSXT to 
    provide more efficient service than would be available on a joint route 
    arrangement. The trackage rights were scheduled to become effective on 
    August 14, 1995.1
    
        \1\ CSXT is restricted to using the trackage rights to provide 
    rail service only to SDI.

        This notice is filed under 49 CFR 1180.2(d)(7). If the notice 
    contains false or misleading information, the exemption is void ab 
    initio. Petitions to revoke the exemption under 49 U.S.C. 10505(d) may 
    be filed at any time. The filing of a petition to revoke will not 
    automatically stay the transaction. Pleadings must be filed with the 
    Commission and served on: John W. Humes, Jr., 500 Water St., J-150, 
    Jacksonville, FL 32202.
        As a condition to the use of this exemption, any employees 
    adversely affected by the trackage rights will be protected under 
    Norfolk and Western Ry. Co.--Trackage Rights--BN, 354 I.C.C. 605 
    (1978), as modified in Mendocino Coast Ry., Inc.--Lease and Operate, 
    360 I.C.C. 653 (1980).
