    AGENCY:

    ACTION:

    Proposed rule.

    SUMMARY:

    The Commission requests comments on a petition filed by HMW, Inc., licensee of station WPXT, NTSC Channel 51, Portland, Maine, requesting the substitution of DTV Channel 36 for its assigned DTV Channel 4 at Portland. DTV Channel 36 can be allotted to Portland, Maine, in compliance with the principle community coverage requirements of Section 73.625(a) at reference coordinates (43-51-06 N. and 70-19-40 W.). As requested, we propose to allot DTV Channel 36 to Portland with a power of 1000 and a height above average terrain (HAAT) of 265 meters. However, since the community of Portland is located within 400 kilometers of the U.S.-Canadian border, concurrence by the Canadian government must be obtained for this proposal.
