Notice of Public Information Collection(s) Submitted to OMB for
Review and Approval
August 25, 1999.
SUMMARY: The Federal Communications Commission, as part of its
continuing effort to reduce paperwork burden invites the general public
and other Federal agencies to take this opportunity to comment on the
following information collection(s), as required by the Paperwork
Reduction Act of 1995, Public Law 104-13. An agency may not conduct or
sponsor a collection of information unless it displays a currently
valid control number. No person shall be subject to any penalty for
failing to comply with a collection of information subject to the
Paperwork Reduction Act (PRA) that does not display a valid control
number. Comments are requested concerning (a) whether the proposed
collection of information is necessary for the proper performance of
the functions of the Commission, including whether the information
shall have practical utility; (b) the accuracy of the Commission's
burden estimate; (c) ways to enhance the quality, utility, and clarity
of the information collected; and (d) ways to minimize the burden of
the collection of information on the respondents, including the use of
automated collection techniques or other forms of information
technology.
DATES: Written comments should be submitted on or before October 1,
1999. If you anticipate that you will be submitting comments, but find
it difficult to do so within the period of time allowed by this notice,

Title: Application for Consent to Assignment of Broadcast Station
Construction Permit or License or Transfer of Control of Corporation
Holding Broadcast Station Construction Permit or License.
Form No.: FCC Form 316.
Type of Review: Revision of a currently approved collection.
Respondents: Business or other for-profit, not-for-profit
institutions, state, local or tribal governments.
Number of Respondents: 2,700.
Estimated Time Per Response: 1 hour.
Frequency of Response: On occasion reporting requirement.
Total Annual Burden: 2,700 hours.
Total Annual Cost: $1,594,000.
Needs and Uses: The FCC Form 316 is required when applying for
authority for a voluntary/involuntary assignment of a broadcast license
or construction permit or transfer of control of corporation holding
broadcast license or construction permit.
With adoption of the Report and Order contained in MM Docket No.
94-150, 92-51 and 87-154 on August 5, 1999, the Commission has revised
its broadcast ownership attribution rules. The attribution rules define
what constitutes a ``cognizable interest'' for purposes of applying the
ownership rules. In the Report and Order, the Commission adopted (1) an
equity/debt plus attribution rule that would narrow, but not eliminate,
the current exemptions from attribution for nonvoting stock and debt,
as well as the single majority shareholder exemption; (2) attribute
certain television local market agreements (LMA) and modify the radio
LMA rules; (3) retain the 5% voting stock benchmark, but raise the
passive investor voting stock benchmark to 20%; (4) eliminate the
cross-interest policy; and (5) attribute limited liability companies
and other new business forms under the same attribution rules that
apply to limited partnerships.
The FCC Form 316 has been revised to reflect the rules adopted in
the Report and Order. There will be an increase in burden on
respondents to provide the new information.
The data is used by FCC staff to determine if the applicant is
qualified to become a Commission licensee or permittee of a commercial
or noncommercial broadcast station and to carry out the provisions of
Section 310(d) of the Communications Act of 1934, as amended.
