Fox Valley & Western Ltd.--Abandonment Exemption--Kewaunee
County, WI
AGENCY: Interstate Commerce Commission.
ACTION: Notice of exemption.

SUMMARY: The Commission exempts from the prior approval requirements of
49 U.S.C. 10903-10904 the abandonment by Fox Valley & Western Ltd (FVW)
of a 12.35-mile rail line extending between milepost 22.69, near Casco
Junction, and milepost 35.04, near Algoma, in Kewaunee County, WI. This
exemption is subject to standard labor protective conditions.
DATES: Provided no formal expression of intent to file an offer of
financial assistance has been received, this exemption will be
effective on October 12, 1994. Formal expressions of intent to file an
offer of financial assistance under 49 CFR 1152.27(c)(2)1 must be
filed by September 22, 1994, petitions to stay must be filed by
September 27, 1994, requests for a public use condition conforming to
49 CFR 1152.28(a)(2) must be filed by October 3, 1994, and petitions to
reopen must be filed by October 7, 1994.
