Abstract: The National Park Service (NPS) authorizes private
businesses known as concessioners to provide necessary and appropriate
visitor facilities and services in areas of the National Park Systems.
The concessioner Annual Financial Report (Forms 10-356 and 10-356A)
provides concessioner financial information to the NPS as required by
each concession contract. This information is necessary to comply with
requirements placed on the NPS by the Congress.
Public Law 105-391 requires that the NPS exercise its authority in
a manner consistent with a reasonable opportunity for a concessioner to
realize a profit on its operation as a whole commensurate with the
capital invested and the obligations assumed. It also requires that
franchise fees be determined with consideration to both gross receipts
and capital invested. The financial information collected is necessary
to provide insight into and knowledge of the concessioner's operation
so that this authority can be exercised appropriately and franchise
fees determined in a timely manner without undue burden on the
concessioner.
