    CSX Transportation, Inc.--Abandonment Exemption--in Pike County,

    AGENCY: Interstate Commerce Commission.
    
    ACTION: Notice of Exemption.

    SUMMARY: The Commission exempts from the prior approval requirements of 
    49 U.S.C. 10903-10904 the abandonment by CSX Transportation, Inc., of 
    13.16 miles of railroad line between milepost 14.58 at Myra and 
    milepost 23.00 at Shelby Gap, and between milepost 0.00 at Shelby Gap 
    and milepost 4.74 at Fenn, in Pike County, KY, subject to standard 
    labor protective conditions and an historic preservation condition.
    
    DATES: Provided no formal expression of intent to file an offer of 
    financial assistance (OFA) has been received, this exemption will be 
    effective on October 15, 1994. Formal expressions of intent to file an 
    OFA under 49 CFR 1152.27(c)(2)\1\ must be filed by September 23, 1994, 
    petitions to stay must be filed by September 30, 1994, requests for a 
    public use condition conforming to 49 CFR 1152.28(a)(2) must be filed 
    by October 5, 1994, and petitions to reopen must be filed by October 
    11, 1994.
