    Notice of Intent To Make a Noncompetitive Financial Assistance 
    Award to the Navajo Nation
    
    AGENCY: Albuquerque Operations Office, Department of Energy.
    
    SUMMARY: The Albuquerque Operations Office (ALO) of the Department of 
    Energy (DOE), pursuant to the DOE Financial Assistance Rules, 10 CFR 
    600.7, is announcing its intention to enter into a noncompetitive 
    financial assistance cooperative agreement with the Navajo Nation. 
    Assistance of $300,000.00 will support technology development and 
    personnel staff identification for the purpose of the development of an 
    environmental assessment infrastructure for the Navajo Nation. The 
    proposed award will provide the recipient with technical and 
    administrative resources necessary to the identification, 
    understanding, and development of environmental issues impacting Tribal 
    lands and its people.

    SUPPLEMENTARY INFORMATION: The financial assistance is authorized under 
    the DOE Organization Act, Public Law 95-91, as amended.
        A non-competitive award is appropriate. In particular, this award 
    meets the criteria of 10 CFR 600.(b)(2)(i) (B), (C), (D), and (E) in 
    that--
        (1) the work to be funded would have been conducted by the tribe 
    using its own resources; however, DOE support of the activity will 
    enhance the ability of the tribe to carry out the activities and 
    benefit the public. DOE knows of no other entity which is conducting or 
    is planning to conduct similar activities.
        (2) the tribe is a unit of government and the activities to be 
    funded are related to the performance of this governmental function 
    within the tribe's jurisdiction.
        (3) the tribe has the exclusive capability to implement the 
    cooperative agreement in consonance with the spirit of a government-to-
    government relationship. The tribe is the governmental authority that 
    has jurisdiction over Indian lands affected by DOE facilities and 
    activities.
        (4) the tribe is a sovereign entity for certain purposes, and in 
    that respect, is similar to a foreign government. The purpose of the 
    cooperative agreement is to extend the value of the previously signed 
    Accord, thus affirming and strengthening the Government-to-Government 
    relationship between DOE and the tribe.
