DEPARTMENT OF JUSTICE
Notice of Lodging of Consent Decree Pursuant to the Comprehensive
Environmental Response, Compensation and Liability Act
In accordance with the policy of the Department of Justice, notice
is hereby given that a proposed consent decree in United States v.
Buyken Industries, et al., Civ. No. C97-1416D, was lodged with the
United States District Court for the Western District of Washington, on
August 27, 1997. That action was brought against defendants pursuant to
section 107 of CERCLA for the recovery of response costs incurred and
to be incurred at the Western Processing Superfund Site in Kent,
Washington. Because the defendants have contributed minuscule amounts
of hazardous substances to the Site (less than .002% of the wastes
received at the Site), they are considered ``de micromis'' contributors
of hazardous substances to the Site. Consistent with the ``Revised
Guidance of CERCLA Settlements with De Micromis Waste Contributors,''
dated June 3, 1996, the United States has settled with these parties in
exchange for certain certifications and covenants made by them. The
settlement is designed to resolve fully each settling party's liability
at the Site through a covenant not to sue under sections 106 and 107 of
CERCLA, 42 U.S.C. 9606, 9607, and section 7003 of the Resource
Conservation and Recovery Act, 42 U.S.C. 6973.
The Department of Justice will receive comments relating to the
proposed consent decree for a period of 30 days from the date of this
publication. Comments should be addressed to the Assistant Attorney
General of the Environment and Natural Resources Division, Department
of Justice, Washington, DC 20530. All comments should refer to United
States v. Buyken Industries, et al., D.J. Ref. 90-7-1-233A. Commenters
may request an opportunity for a public meeting in the affected area in
accordance with section 7003(d) of RCRA.
The proposed consent decree may be examined at the office of the
United States Attorney for the Western District of Washington, 3600
Seafirst Fifth Avenue Plaza, 800 Fifth Avenue, Room 3600, Seattle, WA
98104, at the Region X office of the Environmental Protection Agency,
1200 6th Avenue, Seattle, WA 98101, and at the Consent Decree Library,
1120 G Street, NW, 4th floor, Washington, DC 20005, 202-624-0892. A
copy of the proposed consent decree may be obtained in person or by
mail from the Consent Decree Library. In requesting a copy, please
enclose a check in the amount of $2.75 for the decree (25 cents per
page reproduction costs) payable to the Consent Decree Library. When
requesting a copy, please refer to United States v. Buyken Industries,
et al., D.J. Ref. 90-7-1-233A.
Bruce Gelber,
Deputy Chief, Environmental Enforcement Section, Environment and
Natural Resources Division.
