    Termination of Recreation and Public Purposes (R&PP) 
    Classification and Opening Order; New Mexico
    
    AGENCY: Bureau of Land Management, Interior.
    
    ACTION: Notice.

    SUMMARY: This notice terminates R&PP Classification, NMNM 32098. The 
    land will be opened to the public land laws generally, including the 
    mining laws. The land has been and remains open to the mineral leasing 
    laws.
    
    DATES: Termination of the classification is effective September 22, 
    1994. The land will be open to entry at 8:00 a.m. on October 24, 1994.

    SUPPLEMENTARY INFORMATION: On November 16, 1978, R&PP Lease NMNM 32098 
    was issued to the Board of County Commissioners, Otero County. The said 
    lease has been relinquished and the case is closed.
        Pursuant to the R&PP Act of June 14, 1926, as amended (43 U.S.C. 
    869 et seq.), and the regulations contained in 43 CFR 2461.5 (b)(2), 
    R&PP Classification NMNM 32098 is hereby terminated in its entirety and 
    the segregation for the following described land is hereby terminated.
    
    New Mexico Principal Meridian
    
    T. 22 S., R. 8 E.,
        Sec. 14, SW\1/4\SE\1/4\SW\1/4\.
    
        Containing 10.00 acres in Otero County.
    
        The classification no longer serves a needed purpose as to the 
    land described above and is hereby terminated.
    
        At 8 a.m. on October 24, 1994 the land will be open to the 
    operation of the public land laws, subject to valid existing rights, 
    the provisions of existing withdrawals, other segregations of record, 
    and the requirements of applicable law. All valid applications received 
    prior to or at 8 a.m. on October 24, 1994, will be considered as 
    simultaneously filed. All other applications received will be 
    considered in the order of filing.
        At 8 a.m. on October 24, 1994, the following described public land 
    will also be open to the operation of the mining laws. Appropriation of 
    lands under the general mining laws prior to the date and time of 
    restoration is unauthorized. Any such attempted appropriation, 
    including attempted adverse possession under 30 U.S.C. 38, shall vest 
    no rights against the United States. Acts required to establish a 
    location and to initiate a right of possession are governed by State 
    law, where not in conflict with Federal law. The Bureau of Land 
    Management will not intervene in disputes between rival locators over 
    possessory rights since Congress has provided for such determination in 
    local courts.
