Submission for OMB Review; Comment Request
The Department of Commerce (DOC) has submitted to the Office of
Management and Budget (OMB) for clearance the following proposal for
collection of information under provisions of the Paperwork Reduction
Act (44 U.S.C. Chapter 35).
Agency: Bureau of Export Administration (BXA).
Title: Chemical Weapons Convention (Notifications, Annual Reports,
and End-User Certificates).
Agency Form Number(s): None.
OMB Approval Number: 0694-0117.
Type of Request: Extension of a currently approved collection.
Burden: 176 hours.
Average Time Per Response: 30 minutes each.
Number of Respondents: 134 (multiple responses).
Needs and Uses: The Chemical Weapons Convention (CWC) is a
multilateral arms control treaty that seeks to achieve an international
ban on chemical weapons. The U.S. is under obligation by this treaty to
impose certain trade controls since the CWC prohibits the use,
development, production, acquisition, stockpiling, retention, and
direct or indirect transfer of chemical weapons. Under the Treaty,
States Parties may only export Schedule 1 chemicals to other States
Parties, must provide advance notification of exports of any quantity
of Schedule 1 chemicals, and must submit annual reports of exports of
such chemicals during the previous calendar year. The Convention also
requires that prior to the export of Schedule 2 or Schedule 3 chemicals
to a non-States Party, the exporter must obtain an End-Use Certificate
issued by the government of the importing country. This information is
used to ensure that export transactions are in compliance with
obligations under the Convention and is shared, as appropriate, with
the Organization for the Prohibition of Chemical Weapons.
