    Take notice that the following hydroelectric application has been filed with the Commission and is available for public inspection:

    a. Application Type: Surrender of Small Conduit Exemption.

    b. Project No: 9699-001.

    c. Date Filed: July 6, 2005.

    d. Applicant: Albany Hydro Associates.

    e. Name of Project: Albany Hydro Development Project.

    f. Location: At the Water Transmission Main at the Albany Water Filtration Plant, Albany County, New York. No lands of the United States would be affected.

    g. Filed Pursuant to: Federal Power Act, 16 U.S.C. 791a-825r.

Description of Request: The Applicant proposes to surrender its exemption for the 130-kilowatt Albany Hydro Development Project because the power sales contract has expired and new rates are not cost effective to keep the facility operating.
