Re: Shipment of Citrus Trees Tropic Central Inc manages sales to large retailers both in the State of Florida and outside the State of Florida for Record Buck Farms. Sales outside the State of Florida consist of 1 gallon and 3 gallon container citrus trees sold to large retailers for the home indoor/patio market. We do not now and we have not in the past sold citrus trees in to citrus producing states because the laws of those states prohibit citrus trees from entering those states. Record Buck Farms is in full compliance with all rules and regulations and growing practice requirements and is currently spending substantial sums of money to meet the deadlines for implementation of new regulations adpoted this year. Record Buck Farms is inspected every 30 days or less. Section 301.75-6, paragraph (a) of the executive order conditions the ability of Record Buck to ship out of State upon the inspection of every nursery in the State. While our nursery is in full compliance and is inspected and free of disease and we ship to non citrus producing states: First; we should not be held accountable for risks to citrus producing states, and Second; it is unfair and unjustifiable to penalize our ability to ship because some other nurseries in the State may not be inspected in a 45 day interval; whether or not those nurseries ship out of State. Further, we believe the condition imposed by paragraph (a) to be illegal and as it imposes an unforseen financial impact on our business, we request immediate relief from this rule by modification of paragraph (a).
