The rule appears to apply only to citrus trees shipped from an approved USDA-APHIS approved greenhouse facility directly to an out of state customer. There is and has been for many years a class of citrus trees grown for the tourist market. These trees are marketed at retail outlets located within the State of Florida. These retail outlets are licensed and inspected by the Division of Plant Industry
Prior to leaving the approved greenhouse facility this class of trees are sealed in a plastic bag which in turn is placed in a carboard carton, making contamination impossible. All of the requirements of this rule can be accomplished in the growing and shipping of this class of trees. Further these trees are seedlings and documents used to support this rule, as well as others show that greening and canker are not seed transmittable. Seed treatment procedures have been established to insure against the seed transmission of either disease.
Limited permits need to be allowed to be issued to cover the aforementioned tree movement from an approved facility to an inspected and licensed retailer to be sold for interstate movement.
