§1455.11 Application procedure. (b) Single application. Pennsylvania does not have a single agency with jurisdiction over all wildlife-dependent recreation. In Pennsylvania, responsibilities for fish and wildlife are divided between the Pennsylvania Game Commission and the Pennsylvania Fish and Boat Commission and both agencies have highly successful public access programs that operate independently. Because of the long-standing legislative separation of these two state agencies, it is impracticable for the agencies to submit a joint application. VPA-HIP should provide the flexibility for multiple State fish and wildlife agencies within a State to submit applications and be allowed to participate in the competitive grant processes. All qualified proposals should be reviewed, scored, ranked and grants awarded based on these competitive processes, not based on which State agency was the first to submit an application. §1455.21 Additional Responsibilities of Grantee. (c)(7)Purchase, rent or pay for the installation of fixed equipment, other than property identification signs; The rule uses the term fixed equipment and the RFA uses the term to general-purpose equipment neither of which is an eligible purpose. Fixed equipment such as fence and gate modifications, kiosks, parking lots or designated parking areas, maintenance or installation of travel corridors are types of “fixed equipment” PFBC uses and needs to make available to landowners in order to secure public access to private lands, maximize landowner enrollment and facilitate public use. Additionally, hard points for launching canoes, kayaks, and others such watercraft may be required to facilitate fishing access. Designated parking areas reduce conflicts between anglers and adjoining property owners. Payments to landowners for conservation easements that provide for permanent public access should be included clearly as an eligible program expense .
