Appendix A–6 to Regulation E, which sets forth model clauses for electronic check conversion transactions, appears to include a subsection that has become superfluous. The relevant section appears on page 81036 of volume 76 of the Federal Register, Dec. 27, 2011. Section (c) of Appendix A–6, “Notice For Providing Additional Information About Electronic Check Conversion,” coincides with the requirements of former 12 CFR 205.3(b)(2)(iii), which expired on Dec. 31, 2009 as noted at 76 Fed. Reg. 81020. In my opinion, retention of this portion of the old Appendix A–6 may cause confusion because it appears to urge adoption of a model disclosure that is not required under current law.
