In addition to the matters under scrutiny in this proposal, I wish to point out an error in the Interim Final Rule published by the CFPB on 12/27/2011 (76 FR 81020). On page 81023, the fefinition of "State" at 12 CFR 1005.2(l) reads as follows:
(l) "State" means any state, territory, or possession of the United States; the District of Columbia, the Commonwealth of Puerto Rico; or any political subdivision of the thereof in this paragraph (l).
The Board's predecessor regulation, at 12 CFR Part 205, gave the definition as:
(l) "State" means any state, territory, or possession of the United States; the District of Columbia; the Commonwealth of Puerto Rico; or any political subdivision of the above in this paragraph (l).
The Board's definition, while it may sound a bit clumsy, is grammatically correct. The CFPB's, unhappily, is both confused and grammatically wrong, perhaps after an attempt to improve on the Board's language.
