Since Donald M. Berwick has not been confirmed by the U.S. Senate, I recommend that Centers for Medicare & Medicaid Services (CMS) explain why Mr. Berwick signed this regulation as the Administrator of CMS , rather than signing this proposed regulation as the Acting Administrator of CMS.
