In January 2012, CMS implemented Section 6404 of the Patient Protection and Affordable Care Act. Section 6404 established a maximum period for submission of Medicare claims to not more than 12 months. However, in this proposed rule, CMS is proposing to allow physicians and non-physician practitioners to remain enrolled in Medicare for an unlimited time if they do not bill the Medicare program. I recommend that CMS explain why physicians and non-physician practitioners should remain enrolled in the Medicare program if they cannot bill for services before 12-months from the date of service. I recommend that CMS explain the linkage, if any, between the current regulatory deactivation policy and the maximum period for claim submission.
